Terms and Conditions of Entry

  1. Information on how to enter and prize details form part of the terms and conditions of entry into the Cipriani Bellini Competition 2023 (Promotion).
  2. Entry into the Promotion is deemed acceptance of these terms and conditions (Terms).
  3. The promoter is Alepat Taylor Limited (ABN 57 010 833 744) of 62 Albert Street, Preston, Victoria 30722020 (phone: 03 9487 2599) (Promoter).
  4. The prize is a cruise in Australia for two (2) people, both aged 21 years or over, with a maximum value of AU $3,000 (Prize).

Duration of Promotion

  1. The promotion commences at 12:01am (AEDT) on 1 April 2023 and closes at 11:59pm (AEDT) on 1 June 2023 (Promotion Period).
  2. Entry is open to residents of New South Wales, Victoria, and Queensland, aged 21 years or older (Eligible Entrants), excluding directors, management, employees, and their immediate families of the Promoter and each of their related bodies corporate.

Entry into the Promotion

To participate and be eligible to win, Eligible Entrants must purchase a bottle of Cipriani Bellini from any location (in-store or online) in Australia, scan the QR code  available on the neck label of the Cipriani bellini bottle and complete the entry form including providing the entrant’s personal details and uploading a proof of purchase (photo or scanned copy of the receipt or a screenshot of the online order confirmation) on the entry form at the website located at  https://www.originalbellini.com.au/competition/ during the Promotion Period (Eligible Entry).

  1. Proof of purchase: The entrant must retain proof of purchase. The proof of purchase required is an original receipt for the qualifying transaction.
  2. The entrant must fill out the online entry form for every entry.
  3. An Eligible Entry will be deemed accepted when received by the Promoter.
  4. The Promoter reserves the right, at its sole discretion, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant or invalidate any entry that is not in accordance with these Terms (including forged, manipulated or tampered entries). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. The Promoter accepts no responsibility for and is not liable for:
  • entrants who are unable to enter the Promotion due to incorrect or missing information; or
  • entrants who are unable to enter due to technical difficulties, restricted access to technology or for errors that may occur when submitting entries due to technical problems; or
  • entries that are incomplete, incorrect or not correctly lodged; or
  • entries outside the Promotional Period; or
  • entries not received for any reason including late, lost or misdirected entries.

Drawing of Promotion

  1. The Promotion will be drawn at 2:00pm (AEDT) on 8 June 2023 at Taylor Ferguson & Co Pty Ltd trading as Alepat Taylor, Level 1, 62 Albert Street, Preston VIC 3072.
  2. The winner will be notified by either telephone or email within two (2) business days of the Promotion being drawn. The name of the winner will also be published on the Promoter’s website located at originalbellini.com.au/competition from 9 June 2023 for a period of 28 days. The winner will also be published in The Australian newspaper on 28 August 2023.

The Prize

  1. The maximum total prize pool is AUD $3,000 based on the recommended retail value at the time of printing.
  2. The Promoter accepts no responsibility and is not liable for any variation in the value of the Prize.
  3. The Prize is:
  • for personal use and not to be resold; and
  • not transferrable or exchangeable and cannot be taken as cash.

  • 4 nights on a Majestic Princess Cruise. Roundtrip from Sydney – Hobart – Sydney.
  • Return Economy airfares for two (2) people from the winner’s nearest Australian Capital City to Sydney, on an airline selected by the Promoter. Return flights are not open returns and a fixed return date will be issued on booking.
  • Includes the transfer to the Port of Sydney (From Sydney Airport or another location within the Sydney metropolitan area, at the Promoter’s discretion).

  1. The Prize must be taken on 15 November 2023 until 19 November 2023 (Travel Period). The Promoter will arrange the itinerary of the Prize for the Travel Period and provide this to the winner.
  2. The Prize winner and their guest must be available to travel during the Travel Period. Inability to travel during this time will result in the forfeiture of the Prize.
  3. There can be no changes to travel arrangements once tickets have been issued, or accommodation bookings once the reservation is confirmed.
  4. If the winner or their guest resides in the Prize origin or destination, they will forfeit that airfare and airport transfer portion of t­he Prize, and no compensation will be paid or given in lieu.
  5. Accommodation and flights are not upgradeable.
  6. The Promoter accepts no responsibility and is not liable for any additional accommodation costs including hotel damages caused by the winner or their guest, room service, or incidentals.
  7. The Prize includes GST and taxes included in the price of the tickets.
  8. Unless otherwise stated, the Prize does not include travel insurance, spending money, or taxes not included in the price of the tickets, ground transportation, or any other costs of a personal nature.
  9. Compliance with any health or other government requirements is the responsibility of the winner and their guest. It is the responsibility of the winner and their guest to ensure that they have the full and correct documentation for travel.
  10. The Promoter makes no representation as to the safety, conditions, or other issues that may exist at any Prize travel is subject to Princess Cruise General Conditions of Carriage which are available at [https://www.princess.com/].
  11. If the Promoter is unable to provide the Prize (or part of the Prize), the Promoter, at its discretion, may substitute the Prize (or that part of the Prize) with an alternative prize of equal or greater monetary value to the nominated prize, subject to any written directions from a regulatory authority.

Right of the Promoter to redraw

  1. The Promoter reserves the right to redraw the Promotion in the event of an entrant being unable to satisfy these Terms or forfeiting or not claiming the Prize.
  2. If the Prize remains unclaimed at 5:30pm (AEDT) on 10 August 2023, the Promotion will be redrawn at 2:00 pm (AEDT) on 21 August 2023 at Taylor Ferguson & Co Pty Ltd trading as Alepat Taylor, Level 1, 62 Albert Street, Preston VIC 3072, subject to any written direction given under applicable law. The winner determined in accordance with this clause will be notified by phone or email within two (2) business days of the Promotion being redrawn and the name of the winner will be published on the Promoter’s website located at originalbellini.com.au/competition from 28 August 2023 for a period of 28 days. The winner will also be published in The Australian newspaper on 28 August 2023.

Limitation of liability and variation of Terms

  1. If, for any reason, the Promotion is not capable of running as planned due to any reason beyond the reasonable control of the Promoter (including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes), the Promoter reserves the right, in its sole discretion and to the fullest extent permitted by law to take any action that may be available subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion.
  2. The Promoter excludes all warranties in relation to supply of the Prize, except those that cannot be excluded by law.
  3. To the extent that these Terms are unenforceable or do not comply with the law, that term is to be read down, or excluded to the extent required to comply with the law.
  4. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or indirect loss) or personal injury suffered or sustained in connection with this Promotion.
  5. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.

Privacy

  1. By entering the Promotion, the entrant understands and agrees that the Promoter may collect, use and disclose the information provided by the entrant for the purposes of conducting the Promotion and for other purposes of collection as set out in the Promoter’s Privacy Statement available at https://alepat.com.au/privacy-policy/. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting the Promotion or communicating with entrants and to State and Territory lottery departments and the winner’s names may be published as required under the relevant legislation. The entrant agrees that the Promoter can continue to contact them even after the Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phone [03 9487 2599] or email [marketing@alepat.com.au].
  2. By entering into the Promotion, the entrant agrees and acknowledges that:
  • they may be contacted by the Promoter to provide comments about the Promotion, and the Promoter (or an agent of the Promoter) may take photos of them;
  • the Promoter may use such comments or photos (Materials) for the Promoter’s future promotional and marketing purposes without further reference or compensation to them;
  • the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
  • on creation of the Materials they grant to the Promoter a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
  • they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights);
  • they waive all Moral Rights in the Materials that arise outside Australia; and
  • they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.

Alcohol Guidelines

  1. The Promoter encourages consumers to enjoy alcohol in moderation. Legal-aged consumers are advised to consider the ‘low-risk drinking’ guideline recommended in the National Health & Medical Research Council Australian Alcohol Guidelines. Participation in the Promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol.
